1. Acceptance
By accessing the Site, creating an account, or placing an order (rental or purchase), you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.
2. Eligibility
You must be at least 18 years old and have the authority to bind the company or entity you represent. You warrant that all information you provide is accurate, current, and complete.
3. Accounts
- You are responsible for safeguarding your login credentials and for all activities under your account.
- We may suspend or terminate your account if we suspect a breach of these Terms, fraud, or any risk to the Site or others.
4. Website Content
All content on the Site (including texts, images, logos, product data, and manuals) is owned by RJGC or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or scrape any content without our prior written permission.
5. Orders, Quotes & Pricing
- Prices, specifications, availability, and promotions are subject to change without notice.
- A quote provided on the Site is an invitation to treat and does not constitute a binding offer. A binding agreement arises only when we issue a written order confirmation or sign a separate contract.
- We reserve the right to reject or cancel any order/booking (e.g., due to availability, pricing errors, credit issues, or compliance concerns). If payment has already been collected, a full refund will be issued.
6. Rentals – Key Terms
- Start & End of Hire:
- If you arrange transport: hire starts when the equipment leaves our yard and ends when it is returned and checked in (Saturday–Thursday, 07:00–18:00).
- If we arrange transport: hire starts upon arrival at your site and ends when the equipment is received at our yard.
- Minimum Hours: Daily 10h, Weekly 60h, Monthly 260h. Extra hours are charged pro‑rata.
- Your Responsibilities: Provide certified operators, PPE, a safe site, necessary permits/access, fuel, daily checks, routine care, and protection from theft, vandalism, and adverse weather.
- Damage & Loss: You are liable for loss, damage, misuse, punctures, abnormal wear, and consumables.
- Breakdowns: Notify us immediately. Repairs due to misuse or operator error will be charged.
- Insurance: Maintain “all‑risk” insurance covering the equipment and third parties throughout the hire period.
- Off‑Hire: Send off‑hire notice by email before 18:00 (Saturday–Thursday). Hire charges continue until the equipment is collected/returned and off‑hire is confirmed.
- Branding: Do not remove or obscure any RJGC labels or identification marks.
- Transport: If you arrange transport, use licensed drivers and roadworthy vehicles.
7. Sales – Key Terms
- Title to goods passes only upon full payment, unless otherwise agreed in writing.
- Unless expressly stated, goods are sold “as is” with only the manufacturer’s warranty (if any).
- Returns require prior written approval and may be subject to inspection and restocking fees.
8. Delivery & Risk
Delivery dates are estimates. Risk of loss or damage passes to you upon delivery (for sales) or upon handover at your site/our yard (for rentals). You must provide safe access and adequate unloading facilities.
9. Payment, Taxes & Invoices
- Payments are due as stated on the invoice or contract. Late payments may result in suspension of services and legal recovery, while charges continue to accrue.
- All prices exclude VAT and other applicable taxes unless stated otherwise. Saudi VAT will be applied where required by law.
10. Promotions & Coupons
Promotions and coupons are time‑limited, non‑transferable, and may be subject to usage limits and exclusions. We reserve the right to modify or withdraw any offer at any time.
11. Prohibited Use
You may not: violate any law; reverse‑engineer or disrupt the Site; upload malware; perform unauthorized data mining; impersonate any person or entity; or publish unlawful, defamatory, or infringing content.
12. Third‑Party Links
The Site may contain links to third‑party websites. These are provided for convenience only; we are not responsible for their content, products, or policies.
13. Privacy & Cookies
Please refer to our Privacy Policy for information on how we collect, use, and protect your personal data and your cookie choices.
14. Warranties & Disclaimers
The Site and all content are provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non‑infringement. We do not guarantee uninterrupted or error‑free operation of the Site.
15. Limitation of Liability
To the maximum extent permitted by applicable law, RJGC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits. Our total liability arising out of or related to these Terms or your use of the Site shall not exceed the amounts paid by you to us for the specific order or rental giving rise to the claim.
16. Indemnity
You agree to indemnify, defend, and hold harmless RJGC, its officers, employees, and agents from any claims, damages, penalties, and costs (including legal fees) arising out of your breach of these Terms, misuse of equipment, or violation of any law or third‑party rights.
17. Force Majeure
Neither party shall be liable for any delay or failure to perform due to events beyond its reasonable control, including but not limited to acts of God, government actions, war, strikes, or network failures.
18. Termination
We may suspend or terminate your access to the Site or cancel any bookings if you breach these Terms. All payment obligations accrued before termination remain due.
19. Governing Law & Disputes
These Terms shall be governed by the laws of the Kingdom of Saudi Arabia. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved amicably. If no amicable resolution is reached, the dispute shall be submitted to the competent courts in Al Khobar, Saudi Arabia.
20. Changes to Terms
We may update these Terms at any time by posting a revised version with a new effective date. Your continued use of the Site after such changes constitutes your acceptance of the new Terms.
21. Entire Agreement
These Terms, together with our Privacy Policy and any order confirmation or signed agreement, constitute the entire agreement between you and RJGC regarding your use of the Site and supersede all prior understandings.
22. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
23. No Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
